We’ll Be Waiting for You to Bring Ofori-Atta Back – Frank Davies Challenges Special Prosecutor

 

Frank Davies, a member of the legal team representing former Finance Minister Ken Ofori-Atta, has acknowledged that the Office of the Special Prosecutor (OSP) is within its mandate to pursue legal action against his client. However, he has criticized the manner in which the office is handling the case.

Mr. Ofori-Atta, currently under investigation for alleged corruption, had requested to engage with the OSP via a virtual meeting in response to an official summons, citing ill health. The request was denied. Subsequently, the OSP declared him a wanted person and initiated the process to secure an INTERPOL Red Notice, which could lead to his arrest and extradition.

Speaking in a media interview on Monday, June 2, 2025, Mr. Davies expressed concern over what he described as the OSP’s disregard for formal communications from Ofori-Atta’s legal team, accusing the office of bypassing due process and acting with bias.

“I want to believe he [the Special Prosecutor] knows exactly what he’s doing. Just because you’re at the Office of the Special Prosecutor doesn’t mean you can enter the public domain and claim, without evidence, that there is no medical report. How did he determine that Ken Ofori-Atta was suffering from cancer?” Davies questioned.

He added:
“I won’t entertain any form of frivolity. If he insists Ken is fleeing justice and has now declared him a fugitive, then we’ll all be here—waiting—for him to bring Ken Ofori-Atta back to the country.”

At a press briefing in Accra on the same day, Special Prosecutor Kissi Agyebeng confirmed that a formal request had been submitted to INTERPOL for the issuance of a Red Notice. He stated that the move was necessitated by Mr. Ofori-Atta’s repeated failure to appear for questioning, which the OSP views as obstructing the ongoing investigations.
